General terms and conditions

Article 1 - Definitions

In these terms and conditions the following terms shall have the following meanings:

  1. Cooling-off period: The period within which the consumer can make use of his right of withdrawal.
  2. Consumer: The natural or legal person who purchases a product or service from Zekering.com.
  3. Day: Calendar day.
  4. Duration transaction: A distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.
  5. Durable medium: Any instrument that enables the consumer or entrepreneur to store information for future consultation and unchanged reproduction.
  6. Right of withdrawal: The possibility for the consumer to cancel the distance contract within the cooling-off period.
  7. Model form: The form that the entrepreneur makes available for withdrawal.
  8. Entrepreneur: The natural or legal person who offers products and/or services remotely.
  9. Distance contract: A contract for which exclusive use is made of distance communication techniques.
  10. Distance communication technology: A means that can be used to conclude an agreement without the consumer and entrepreneur being in the same room at the same time.
  11. General Terms and Conditions: These General Terms and Conditions of the entrepreneur.

Article 3 - Applicability

  1. These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded.
  2. The text of these general terms and conditions will be made available before or upon conclusion of the agreement.
  3. If the agreement is concluded electronically, the text can be provided electronically.
  4. In the event of conflicting general terms and conditions, the consumer can rely on the most favourable provision.
  5. If a provision is void, the remainder of the agreement shall remain in force.

Article 4 - The offer

  1. An offer with a limited period of validity is clearly stated.
  2. The offer is without obligation and can be adjusted.
  3. The description of products is complete and accurate.
  4. Images are true representations of the products.
  5. The offer contains clear information about rights and obligations, such as price, shipping costs and right of withdrawal.

Article 5 - The Agreement

  1. The agreement is concluded when the consumer accepts the offer.
  2. In case of electronic acceptance, the entrepreneur confirms receipt.
  3. The entrepreneur ensures a secure web environment for electronic payments.

Article 6 - Right of withdrawal

The consumer has the right to cancel within 14 days after receiving the product.

Article 7 - Costs in case of revocation

  1. The consumer bears the costs of return.
  2. The entrepreneur will pay back within 14 days in the event of a valid cancellation.

Article 8 - Exclusion of the right of withdrawal

  1. The right of withdrawal can be excluded for custom-made products.
  2. The entrepreneur must clearly state this in the offer.

Article 9 - The price

  1. Prices will not be increased during the validity period of the offer, unless VAT rates change.
  2. Price increases within 3 months after the agreement are not permitted without legal reason.

Article 10 - Conformity and warranty

  1. The entrepreneur guarantees that products comply with the agreement.
  2. Any defects must be reported within 2 months.

Article 11 - Delivery and execution

  1. The entrepreneur executes orders with care.
  2. Delays will be reported within 30 days.

Article 12 - Duration transactions

  1. The consumer can cancel an agreement with a notice period of up to one month.

Article 13 - Payment

  1. The consumer must pay within 7 working days, unless otherwise agreed.

Article 14 - Complaints procedure

  1. The entrepreneur will handle complaints within 14 days.

Article 15 - Disputes

Agreements are exclusively governed by Dutch law.

Article 16 - Additional or deviating provisions

Additional provisions may not be detrimental to the consumer.

Article 17 - Liability

  1. Zekering.com is not liable for indirect damage.
  2. The maximum liability is limited to the value of the order.
